I have a federal case where opposing counsel continues to demand we file our “notice of intent to serve” a non-party subpoena with the Clerk. I know FRCP requires we provide notice to the other parties, but I’ve never known the rule the require the notice be filed. Have I missed something?

Check local rules—sometimes they have to be filed, sometimes they don’t. Ask OC for the rule citation, better yet lol

Check the local rules. If it’s not required and they still insist, either ignore them or tell them they’re more than welcome to do a notice of filing your notice if it bothers them that much. They on the defense side?

If it did change, we missed the memo because we severed a handful of these last week and o/c didn’t say anything.

May depend on the state/court. In FL, we filed the notice of intent in both state and federal court. A firm I worked with in GA didn’t do it for either tho.

Law clerk still figuring out legal research. My firm uses Lexis and I did some jury verdict research. A partner later asked that I limit this to sustained verdicts but I can’t figure out the best way to do this. I reached out to Lexis, but their recommendation that I add “outcome(sustained)” brought my results to 0 no matter how wide I made the search. Is there a better way? Is there a way to check the cases I had found previously? Any advice is appreciated!!!

I am a 2nd year associate at a plaintiff’s firm specializing in toxic tort cases (individual). I’ve had the opportunity to be third chair on a trial, and will likely be second chair in an upcoming trial. My client (subK) was never paid by the gen K or the property owner for work/materials and wants to sue. However, they had no K with the property owner, only with the gen K. Other than unjust enrichment, what other claims could we assert against the property owner in the absence of a K between my client and the prop owner. I lateraled from ID to BigLaw. I am finding that the staff upon which I must now rely are not nearly as knowledgeable, skilled and well-trained as those I worked with at my last firm. Litigation attorneys practicing in the Western District of Arkansas - is there any rule prohibiting replies to motions in limine? I just checked the local rules and did not find anything addressing replies other than MSJ motions, so I’m assuming it’s fine but want to double check.

Writing question: Should a motion, such as one for summary judgment, include a citation after ever sentence? I was taught that every sentence should be followed with a citation. (unless it’s clearly obvious that a sentence doesn’t need one, e.g., “Therefore summary judgment should be granted”) At my new firm, I don’t see that as the practice and was curious what the broader legal community thought.
