You will be fine as long as your new employer starts the PERM process immediately. They will have a 3-year period to get the job done so you should have an approved I-140 by the time it is time for your extension. Best of luck!

Your h1b would stay intact, but unless the new employer files another i140, you won't be able to extend beyond the h1b validity that was based on prior i140 approval anymore. Confirm with law firm
