I have a serious question regarding this because time is running out. I quit my job last year on Nov 5. I had about two weeks of PTO accrued and I wasn’t paid out my PTO. It was nowhere on company policy other than I was told “it’s known we don’t pay out PTO when someone quits”. Could I file a law suit to get me paid for those accrued hours?

Would legal fees surpass whatever you’re owed? That would make it not worth it

You also want to get your hand on a copy of the policy. It might be worth a lawyer’s time if this is a large company and they can turn this into a class action lawsuit if they don’t pay people out for the pto. Otherwise, it might be hard to get a lawyer since the cost will likely exceed your pay. Sounds like your company is taking a page out of Trump playbook.

You can try small claims court if you are asking for under certain figure. You can represent yourself. I don't believe they can go after you for legal fee in small claims count if you lose. This assume they will hire a lawyer to represent them in small claims count.

Just publicly shame them on social media. ? Sometimes that's enough for them to do something about this

That’s a good idea

It depends. Some states require payout and others don’t.

Well here is a new issue I am troubleshooting today. We have an ADA reasonable accommodation request for gluten free cookies at the reception after the holiday talent show for an employee with celiac disease. I think we might be required to grant this request. Employee has the same right to access the benefits of employment with us as everyone else - here that benefit would be baked goods at the reception. I suppose celiac impairs a major life function - eating, and is a disability. Thoughts?

Firms should provide at least some billable equivalent credit for vacation time. A vacation isn’t actually a vacation if you have to later make up the hours to ensure advancement and/or a bonus.
