A lot of companies are already mostly compliant because the provisions in CCPA are similar to GDPR. For companies that are US only some of them I've seen are scrambling.
The CPO at one of my clients is of the opinion that they don’t need to be in a huge hurry as they don’t think they’d be targeted by the California AG barring a breach. I’m not sure I agree with that, but they still plan to comply, just not to scramble to do so.
this is a fair point, but even FAANG and FSI companies who will be targeted by the AG don't seem to be in as much of a rush to get complaint..
The major exceptions revolve around prior business, like a financial transaction. I’m on a CCPA project and let me tell you, our clients are scared.
There’s a rumor that they won’t enforce anything until mid 2020, so that might be why folks are sleeping on it. Some lawyers want to see the law litigated before they make wholesale changes to the way they store and manage customer data. Not saying that’s the right approach, but that’s what I’m hearing.
I noticed there are pretty generous exemptions which allow companies to ignore deletion requests
Reporting - telling them customer what info you have on them
Non-discrimination - you can’t degrade a customer’s service or otherwise treat them differently because they exercise their rights under CCPA
I forget the fourth high-level area but can check tomorrow.
They should be scared and will be in deep doodoo come Jan 1 if they haven’t prepared. Privacy “advocates” and enterprising attorneys will be targeting sloppy firms with deep pockets. A large home improvement retailer was mentioned on GMA or one of the morning shows the other day in relation to data privacy and CCPA... apparently hundreds of CCPA requests came in already.
