I joined a firm as GC and CCO at the end of last year. I have since learned our upper management are slimeballs. I normally don’t judge clients but these are dishonest people. I want to head out, and have clients that I could take as my own practice but what’s the move here?

I’m confused. Clients of your company? Are you proving legal services? In many jurisdictions non competes for attorneys are unenforceable, but only with respect to the practice of law. Or are you saying you can go take the company’s clients and offer them the services the company is offering? In that case, a non compete could be enforceable.

No I have other clients I can take to start my pen practice, nor do I have a non compete. They’re not enforceable in my Jx for lawyers.

I left my first in-house job as a GC for a client for similar reasons - they weren’t super ethical but CEO was also pretty dumb and didn’t like it when i spotted issues. I would try to ride it out for a year unless you’re concerned about something blowing up before then.

The real issue is that clients everywhere are worse than you think, you are just insulated from it at a firm. If it’s mostly a question of if they want to be more aggressive with risk than you’d like, but they are otherwise sophisticated and listen to your advice on how to manage risk, that’s the best you’ll get.

This is straight from the MPRE. Withdraw as counsel and set up a new practice. Clients don’t listen to your advice . The model rules prevent restricting someone’s access to practice law.

You need to leave. Go elsewhere.

Has anyone heard about an offer for employment be rescinded because the background check showed a drivers license suspension 2 years ago due to a third party firm error not informing me on the results of the disputed ticket and requirement to pay ticket fees within specified time. I’m a senior associate and received an offer to join a very profitable client as general counsel that would open lots of doors professionally and financially.
