I just want to vent - working opposite from a litigator on a sale. She’s like 50+ years old but don’t understand the difference between a closing condition and a seller covenant and does not understand how to read defined terms… god help me

Real estate is one of the few practices where attorneys (who don’t practice RE) dabble. Not sure why. I’m a CRE attorney and closed, as buyer, on my home earlier this year. Sellers counsel was an insurance defense attorney. I had to hold his hand through the process. He tried to cancel closing at 9pm the night before (for literally no reason). Not sure how these people feel comfortable jumping into residential RE or, even worse, commercial.

I had a litigator giving a local counsel opinion once. He was about 70 years old and I had to explain to him how creation and perfection work, including sending him code references and excerpts. Not sure how borrower’s counsel found him.

The problem is that you are a CRE attorney. I’ve become one, but I once tried to do stuff I’d do as GC for my company for personal residence and I got “are you insane?” OC was right. But at least in my instance, OC really was right. And I put the thing in a trust anyway. But canceling a closing at 9:00,pm is weird, though to this day, for personal residences, I hire a local re house attorney. They are very different animals—Comercial and straight-up residential.

I am a real estate attorney. I represented myself in my first couple of closings. The saying that the attorney who represents himself has a fool for a client is 100% true. But even then, I have occasionally done some closings for major clients (okay one in 2020, the last before that was probably 2002). I hate it. I deal with deals in the hundreds of millions or more usually. Clients are business people mostly acting rational. Not so on resi.

Salary expectations/billables at next firm?

I’m at a small law firm (2 partners; I’m the only associate) doing a mix of real estate lit, construction lit, commercial RE closings, co-op/condo law, representing developers of residential high rises in NYC, commercial foreclosures, and some general commercial lit. I’m only making $75k + a bonus of around $10k. I’m in my second year of practice (first year doing sec. 1983 lit at NYCLD). When can I jump ship to a mid-size firm doing commercial RE?

There’s a Nonexclusive Installation and Service Agreement by Comcast/Spectrum that is recorded against title. Is this something that needs to be subordinated? It’s not a lease so an SNDA doesn’t seem appropriate.

For those of you in commercial real estate groups at big firms, what do your hours usually look like? How frequently are you working nights & weekends? I’m at a midsize firm and, since the timing of my deals is pretty predictable, I work long hours during the week but can usually avoid a lot of weekend work (until closing week). I’m entertaining some interview offers from bigger firms and wondering how anomalous my current experience is (4th associate, for reference).
