I love the meaning behind the work we do, but I'm not sure if litigation is it for me. Has anyone else had similar experiences, and if so, how did you handle them?

I went in house a few months ago and it’s so much better in this respect (granted I’m at a very employee friendly business which makes things easier). It went from “why do we have to pay this person” or “how can we fire this person” to planning how we can be better and more generous to employees in a way that’s fair, compliant and scalable with growth. Even with separations, it’s now a matter of how can we do this in a way that allows everyone to keep their integrity and move on in a respectful way (while not exposing the company obviously) versus how soon can we fire this person and how little can we pay to resolve the issue. I think it’s frustrating doing L&E because the very well-intentioned laws are more likely to be abused by undeserving employees than to protect the categories of employees they’re intended to protect. But ultimately you need to be working with a business (or client) that understands the importance and delicateness of corporate culture and values it’s people. Otherwise, switching from litigation to advice and counsel alone won’t do much to modify the frustration.

Sometimes amicable resolution just won’t do with crazies or the delusional. Feels quite satisfying to triumph in court and be officially labelled as being right.
On the flip side, losing in court could also be satisfying, where the issue is caused by stakeholders who went against the initial advice and then led the company to a place where they lose a court battle. They usually learn their lesson afterwards, and yes sometimes it takes losing buckets of cash both in the judgement and the legal fees to learn that lesson.

Also if we in L&E give off feelings of being litigation averse, many employees can sense that and will sue to gain leverage, at least the senior employees will.

So I don’t love or hate litigation, I just see it as part of the complete cycle of L&E, which often involves disputes.

I feel similarly and have been trying to transition into doing more advising on compliance with L&E laws, preparing employee handbooks and employment agreements, etc. It’s easier to stomach the litigation when it’s not all that I do.

I am attempting to lateral to a position at Littler/Ogletree/Jackson Lewis, but I do not have a license in the states where I am applying. Case load= malpractice? Small plaintiff’s firm of 25 attorneys. I was a 2 year associate hired and given 50 active files in pre litigation status. 9 mos later a partner quit and I inherited 45 more. I got up to 105 files. Now I hover at 85 active files in varying stages of pre lit. I asked managing partner for help and was told to settle more claims to lessen my load. Is this what people consider negative work culture?

The vibe I've received from several shareholders over the past week seems to be that there will be hiring freezes and a close analysis of current profitability.
