I need to terminate a direct report due to significant performance issues and his difficulty of working with others. He’s well aware of the issues so this shouldn’t come as much of a surprise. However, I am concerned about how he will react based on his personality and his combative nature. I’ve never had to terminate anyone before and I didn’t hire the guy but he reports to me. Any advice?

Have someone else with you so there is a witness, script out what you are going to say and document what he says. Also, if you’re concerned for your safety, have a security guard nearby when you do it.

Agree, and also try to have the conversation at a time of day/ area where there is a limited audience of other ‘EEs if you expect an emotional scene. And make sure you have a plan in place for the ‘EE to surrender IT assets/ IT lockout if appropriate once he is termed.

I would definitely have HR there. Make sure you document everything. Only talk about performance issues not things that are subjective

Depends on firm practice. No need for you to be there if HR is going to notify him. However, if you are going to do the deed, have a script that tells him that his services are no longer needed. Have HR or another partner in the meeting. Do it first thing to avoid distraction.

Have a script and do not deviate from the script. Have a witness there as well. Work with IT ahead of time so you can lock him out of computer access.

Watched the Chris Watts documentary and couldn’t get over the multi-leveling marketing aspect. In CA, if an employee has to call his employer the night before to see if they are scheduled to work the following day, do they need to be compensated anything if they are NOT called in? Business generation is going to be the bane to my existence. If you use the pomodoro method for time focus and tracking, do you bill in those increments or just keep your billablr timer going the whole time? For example, I work in 25 minute increments for large projects then I get a break. Do I bill .5 for that increment and restart my billing or keep my billing continuously going thereby not rounding up for those 5 min? I have just kept my timer going.

I am looking to leave my very small law firm firm and considering going to a much larger firm. I have some clients that were brought in by other partners but I am deeply entrenched in their work. It would not be easy for another lawyer to get up to speed, but the client contact is technically with another lawyer and I am working with that lawyer also on the file. I also have one client where we could really use some more bodies on the file. More in comments.

Help me understand: I applied and firm asked me for a meeting with a partner. Met with partner and it went well. At end of interview, partner told me that the firm has already brought on junior associates and cannot take on any more until around Q1 maybe (which I already knew and was fine with) but this means the firm cannot commit to continuing the interview process yet and I should keep in touch and f-u in a few months.

My Q: why start the process with first meet and then pause?
