I tested the waters (currently at $105 base)and got offered a position making $125k base +10% comm up to $500k in atty fees that goes to 15% after half a mil in fees. The work is in first party plaintiff (same field im in now). My boss is desperate. He offered to up my base from 105 to 150 and up my EOY bonus to 10k. 200k base salary guaranteed next year in writing if I stay & named partner. some equity the year after.l if I stay. He is a lunatic though. I’m in south Florida. Thoughts on moving?

Get out. No question you should leave under these facts.

I also do first party Plaintiff work. Why do Plaintiff work if you’re not getting a percentage?

Truth…

Current boss DOES NOT offer commission. Strictly base salary. He is pretty psycho and treats employees and his wife (the office manager) like crap. I’m the longest attorney who has ever worked for him (2 years). I get along ok with him but he has his moments. He treats all his employees like pawns in a chess game. He told me “this is what I’m offering you because the market tells me I have to”. Rubbed off the wrong way and made me feel unappreciated given everything I do for him. We are a small 3 atttorney (my boss, me, and a younger atty who plus also leaving) firm).

New place is saying I should be hitting 200k+ my first year with the base + fee commission structure.
Case load is about 50-80 cases right off the bat.

Another question: Should I use his counter as leverage for the new place?

I’m beginning year 4 of practice.

All feedback is greatly appreciated!!

Get out if he does not offer commission given that caseload…

Tricky if you like the other firm. If you don’t like the person you work for now, but will have more autonomy as a partner, where you won’t have to report to him as much, then I can see how tempting it is to stay. If money matters most, then you have an answer. If you value relationships more, then there you go.

In a sense, we’re all pawns. So now, choose your poison or environment. I personally cannot work for someone I don’t respect or for a firm that crosses ethical lines.

What city are you in? Just wondering for comparison!

Man, I WISH I was in your jurisdiction!

Additional Posts in Small Law / Solos

I work at a small, 3 lawyer firm. One of the lawyers is not barred in the state we practice. Because of this, the managing attorney has been having him draft motions and other legal documents and use my name and bar number and having me file them because I will have to appear in court for the matter. Is this normal? I am not provided time to review the materials before I file them so I end up working longer days because I am nervous to file something using my name and bar number.

For background, we have 4 attorneys, the senior associate has about 9 years more experience than I do (I have 6). This person should be paid more than me, I have no problem with that. Is it normal for there to be that big of a difference in pay? I just want to know if I’m getting screwed.
