I was fired two weeks after disclosing disability status for “performance” but was never given a PIP or any formal performance warning. Is this worth pursuing a claim with EEOc even though my employment is at will

I specialized in ADA accommodations. It sounds like you have may have a claim if they did not go through the accommodations process or even attempt to provide a reasonable accommodation.

I’m curious how long you have been working there and at what point did you choose to disclose your disability?

like

It may be worth a conversation with an attorney. Your ex-employer doesn't sound like they covered themselves very well to avoid this. The only exception would be if they could not provide reasonable accommodation for your disability, but that should have been communicated to you. Do you know if they documented any other performance related discussions in your employee file?
Best of luck!

You may have an EEOC claim then.
Im very sorry this happened to you!

Did you ask for an accommodation so your performance could improve? Did you notify HR and start the interactive process?

like

Um wow. OK, how about, you can't fix stupid? This is gonna be an expensive lesson for them...

like

Yes! If they never gave you a performance evaluation or can't provide documentation for their claim, you can be compensated for what seems to be discrimination.

This looks so fishy on paper, so I'd say you probably could build a claim around it. Especially without a performance warning of any sort.

I’ve filed a claim with EEOC before. It takes a long time to get any traction. You need to have proof that you were fired on that. You also need to prove that your manager didn’t provide accommodations when you asked for them.

That is terrible. I am so sorry to hear that. I would def pursue a claim. That doesn't sound like it was just a coincidence to me. Especially if you were never put on a PIP before that.

First time poster here!

After spending 4 years as a mid-level ops manager, I tried to break into HR through talent acquisition. Now after 6 years in TA, I've had a hard time getting out of it. My goal was always to get into a more broad HRBP position, but I've since worked for smaller orgs without a solid HR career path. When I ask about my career goals, they keep telling me, "Soon!" Or "Maybe in 6 months!"

I'm testing SPHR in June. Any advice for securing the type of role I'm aiming for?
