Accept both the offers, let both the companies start your h1b transfer. You are in a critical position.
The startup could have issues transferring your visa as they are new to the process.
If both visas come through, monetarily compensate($5k) the one you are rejecting.

I would go with the staffing agency. The immigration situation is fluid and the start-up could be a risky bet.

Have both of them file the visa, you can do this and it is perfectly legal. Once you get the approval maybe decide then?

All that matters with the startup is how good of an immigration lawyer, potentially suggest you pick them yourself. The startup I’m at uses Envoy Global which I have liked
I would suggest staffing agency. Visa is most important. You can always change jobs later. But if you screw your status, nobody can help.
Who is the startups provider? If they’re reputable it can mitigate some risk. From visa POV Staffing is also risky tbh.
I have been in a very similar situation in the past and I chose the startup. It wasn’t a very good experience with the visa transfer. Firstly the attorney was not that experienced and I received an RFE. The HR asked me to be prepared for the worst and the attorney also wasn’t too sure if the RFE will clear. Eventually my visa got approved but It was a very stressful situation at the first place.
I’d recommend going for a staffing agency. Start up will anyday be open again to recruit you in the future and then you can go for a risk free visa transfer with a job in hand.

Go to the start up and mention to them that the paperwork needs to be done by a good immigration lawyer. That's what eventually matters
Staffing company is dead end for h1b approval...ask startup to pick up immigration form of your choice and get it approved
