How can you possibly be losing out on 40k?
Does your firm match that much? You are implying that you are not fully vested so question the 40k from the firm.
Remember any money you put in you get to keep/take (transept to IRA or me firms 401k)
The only money that you can't take is the money your firm puts in. Also, depending on how long you stayed you could still be part heated (20%, 40%, 60%). Look into your firm's policies.

How long have you been with the firm that in an unvested period unvested part has grown to 40k? Perhaps so. Could happen if the stock price has gone up a lot.
As far as can you negotiate - everything is negotiable.
Depends on if your new firm wants to negotiate. Do they want you that bad?
Pwc is lose all match if <2 years. Lose 80% 2-3. Lose 60% 3-4. Lose 40% 4-5. With stock market appreciation it’s pretty easy to lose that much there
