Your claim will not be denied for performance issues. Misconduct or stealing from an employer is another matter.

Severance is different than unemployment insurance. Severance is paid to you directly by your former employer. If you’re terminated for performance, you will probably not get severance. Unemployment is a public social insurance system. The payments are from the government to you.

I like how P1 comes along and says "lots of wrong info here," and then adds more inaccurate information to the pile. The maximum payout varies by the individual and the state, and can be quite a bit higher than $300 per week. For example, in Washington state, it's $713 per week. In California, it's a $450 maximum. Good try, though.

Well, OP hasn't disclosed that information, and your statement is worded in a broad manner which could be interpreted by some as being information about unemployment compensation in general, versus the specific maximum weekly benefit paid out in Virginia.

Unemployment insurance is administered at the state level. You need to check on the rules in your state. As for whether it will pay for food and rent, that obviously depends on how much you spend. You will not have to live on the street or eat roadkill, but your current lifestyle will probably take a hit.

Have you heard of a PIP? Thought they use those to justify not given you severance or pay after firing.

I am surprised to hear people claim you would get unemployment when fired for any reason. That's not how it's supposed to work. Layoffs are different though.

Unemployment insurance is paid by employers. They pay premiums based on their involuntary turnover experience. The reason for termination has to be quite serious for a claim to be denied. An administrative judge decides these cases. Many times the employer may not even how up.

OP-laid off. Technically I left when they said they could keep me for 70k a year lol! We lost our largest telecom client so they couldn’t afford me and several others. It’s paid out by the state and the company is “fined” on their employment tax. If they do it often enough it can have a large impact.

K1, if you're surprised by this, I guess you've never had to use unemployment and don't understand how it's supposed to work? State law and reason for the firing come into play. Serious misconduct that led to being fired can result in not being able to receive unemployment benefits, and typically what constitutes serious misconduct is determined by the state. Performance reasons wouldn't constitute serious misconduct.

Lots of wrong info here. You can file, and the employer can choose to fight it. It's $300 a week, reduced by whatever severance you received.

Since graduating college 4.5 years ago I’ve worked at three marketing agencies averaging a year and two months at each. I took four months off earlier this year after a layoff to study data science.
