No. GC has to be re-filed with new employer - whole process from labor to I140 approval. Your previous priority date will remain.
Awesome, thanks!!
Assuming you have been at the old firm for 180 days. Thanks in advance for your help!
You have to stay with firm for 180 days after i140 approval. This will help you to keep priority date and extend h1b but mew firm have to do entire process again
Got it. Thanks a lot!!
I guess it's not require until your date is current. But to file 485 you have to go through entire process with your then current firm. However you can switch job on old 140 and keep your h1 extending
Yes new PERM, new I140 which means new prevailing wage determination, recruitment etc etc. good news is that you can start anytime before your date is current and retain your priority date. Once its current, your AC21 wont be applicable anymore and you lose your status if 485 is not filed- for which your i140 at that time should be on current company.
Thanks for the detailed response D1.
Quick clarification: So switching jobs would require me to go through the entire process again, and have my new I140 approved before my next extension. Next extension can be done only on the new I140, but with the old priority date
Are the requirements different if you've filed the i-485? Do you have to start all over again if your i-485 has been pending for 180days?
Bummer - I thought you could just keep extending H1B one approved i140
OP no, your multiple extensions can be done using your old i140. I have done that twice now.
D1, I am a bit confused. If extensions can be done using old i140, new i140 is not needed till your priority is current, right?
Yes op correct but if PD is current and your i140 is not, you are leaving that day. If you are an Indian citizen, then you have lot of time.
