How to transition from law to policy think tank?
I started my own law firm right out of law school. All I do is plaintiffs work. I love it. I have 4 employees now. I started out with a very minimal budget and in my personal experience, you could make the transition to start your own shop with less capital than you think.
The Plaintiffs attorneys I am up against are rolling in in cash and have so much autonomy, which I’ll never have in Corp defense. Being entrepreneurial, I love the idea of hustling for myself. I’m not unaware that it would be without HUGE risks and require a lot of money to start. Realistically, what year/stage are you ready to go on your own? How much trial experience before you go solo. If you’ve done it, what did it cost? Do you regret it?
Seconded. Especially with google scholar having case law, you don’t even really need Westlaw. You don’t need a new legal theory to win P-side cases, you just need new facts (aka a new scheme).
Also lit funding is exploding right now. Talk to a few, and don’t be afraid to negotiate. Also your funder will double as a decent sounding board, because they want you to win. So pick someone you want to work with (smart, team player, not a jerk).
Start with some version of fraud - there’s no shortage of corporate fraud and with google, it’s not hard to find enough facts to draft a complaint under FRCP 9. Also there’s a zillion statutory and common law fraud causes of action.
God speed!
I’m curious to hear how difficult this is. I’m a second year litigation associate that doesn’t see the partner lifestyle as desirable.
Soak up as much experience as you can while in a big firm. I was a proverbial “squeaky wheel,” constantly badgering to get more deposition experience, experience arguing motions, and doing trial prep work. All of that helped my skill in evaluating which cases to bring on once on my own, and gave me a strong foundation of confidence in running my own cases. I still often felt like walking a high wire without a net most of the first few years after starting my own firm - but, I cultivated and maintained a few key relationships with more senior and seasoned attorneys in my same field - and called on them from time to time when I felt “stuck” and needed strategic guidance. Best of luck to you!
2nd year here also interested in going from Insurance Defense to starting my own Plaintiff’s shop. Multiple people here have said it takes less capital than you think. Can you guys be more specific? What kind of things should I stash money away for? How much experience is necessary before making the jump?
I say make the decision to follow your dreams. Once that decision is made everything else will fall into place you will see.
