Idk the rules but I highly doubt this is. Especially if you don’t have any missed calls and the fact that it’s 1am. Call your front desk asap or the cops.
I’ve had two incidents this year where water was leaking heavily from my ceiling late at night. And understand that neighbor downstairs hounding the super to ensure that the people upstairs were using their baths or washers properly.
And she said she woke up at 1AM. So let’s give the super the benefit of the doubt that he knocked and nobody picked up. Go ahead, accuse the man of being a perv, and cancel him. Tsk tsk.
As a Canadian M, it’s really eye opening to see how y’all feel about this. Maybe I’m crazy for trusting my building staff…

A1 I'm from a country with one of the lowest homicide rates in the world and as far as I'm aware we don't have guns. I'm not American. I'd still be entirely mistrustful of anyone, man or woman, who was in my apartment, unannounced, at 1am. Hell they could be a cousin and I'd consider yelling at them to GTFO.
It's not just media. It's reality. The reality of women everywhere. Being followed on the streets for daring to wear a skirt (or just have long hair), being catcalled, being yelled at that I'm prettier when I'm smiling. We're constantly threatened and made to feel uneasy. That's why OP was shaking and sobbing upon finding an unexpected man in her apartment at fucking 1am.
Also, no one has seriously suggested suing anyone so stop with the "lol you kooky Americans and your frivolous suits and your guns!" -- that's such a weird and unprovoked take to bring to this thread.

the landlord just called to apologize. he agrees this is unacceptable and is changing my lock and adding a deadbolt to my door. argh, this sucks
Omg... I am so glad to hear that the land lord apologized. As a married woman my jaw dropped reading some of the comments here as I was single once!!!
I travel all the time..I sometimes stayed at my home or condo alone.. I feel for you .. and I hope you feel calmer and safer at home

update: landlord switched out the lock, added a deadbolt and added one bolt lock thing that slots over the door manually from the inside. I'm contemplating filing a non emergency police report or something. Everyone is so apologetic and I don't wanna cause a scene but also like wtf?
IRS is an idiot, there saved you all some time. Lol this thread would be done way faster if he wasn’t participating and trying to cause drama.

My super has keys to only one of my locks, and he rings the doorbell. This is not normal
absolutely need to report this one to the authorities. 1am while you’re asleep can’t be standard operating procedure
OP you can document everything, provide all evidence of failure to comply whatever and still lose. Scumbag landlords know the rules closely. You can even win the court case and still not get paid out because they know how to avoid getting the settlement attached to them. Best of luck though, hate these kinds of people
They probably should have knocked or announced themselves, but yes, leaks is something they immediately can let themselves in for because waiting can result in major water damage.
Def raise it to the building management/landlord. Even if nothing is preventing them from playing it fast and loose with emergencies, it also in their best interest to be more buttoned up about it. Can't make an urgent repair if your super is getting the cops called on them or dealing with supplemental locks and security, etc.
Call the cops immediately, I'm a guy and I'd run to grab the butcher knife if someone came in

That is terrifying. A door chain is a must-have to prevent your landlord/super/any other rando that has a key from letting themselves into your apartment while you're home.
Also, pretty sure they need to give you at least 24hrs notice to enter the unit, but check your lease agreement to confirm.
The issue is that most emergencies don't come with a 24 hour notice....
Water leaks do need to be fixed right away in some cases, but they should never come into your apartment without contacting you. I’ve lived in 4 different NYC apartments, and nobody from the building has ever come in without asking permission. You should complain to management in writing.

It is acceptable in my view, as an emergency, but he should have knocked — loudly — and called you. Amd announced himself as soon as he opened the door. My company advises our staff not to do this unless absolutely necessary. You never know if a tenant has a gun who would think he was defending himself.

My lease says building people can enter without permission in case of an emergency (and a leak would qualify). BUT they are supposed to try and notify you first. Like ring your doorbell, knock, etc. It sounds like that didn’t happen which is unacceptable. I guess the difficult thing would be you can’t prove he didn’t ring your bell and knock, but I still think you should complain.

agree with VP1, doorchain is a must. Had someone try to intrude my home trying diff key and so i got the chain the following morning

Yikes. I would have been terrified and possibly would have attacked them, hit then with something /called 911 etc.
At minimum 1) put something like this on your door today, and 2) call the landlord yo complain.

This is why I deadbolt the door at night. Yes, a leak is an emergency, but they should be making a reasonable effort to notify you before just barging in at 1 am. I know all our building staff by sight and I’d still be freaked out if someone just opened the door with no notice while I was in bed.

Change your locks, report it to the police and buy pepper spray, and/or a weapon.
