Your feelings on ins law are not unique. But be sure to talk with a lot of people on the other side. The grass is not always greener. Very side has issues, you just have to find the ones that work for you.
I think the primary benefit of insurance defense versus Plaintiffs work is the level of effort required to generate cases. In insurance, you’re constantly billing, which sucks. In plaintiffs work, you’re constantly marketing and wondering where your next paycheck will come from, which sucks.
Financially, there are much higher higher hills and much lower valleys in plaintiffs work. Are you prepared for that? Are you a generally risk averse person.
Just a few things to think about. Agree with the above - “grass is not always greener.”
A2 - not one I’d recommend- my firm blew up, I had to take another gig, then that blew up. Took a pause, got back in on plaintiffs consumer fraud work. Not pretty but I do NOT miss the ID days. I do think a lot of defense folks miss that they have some excellent risk management skills - an easy pivot if you want to check that out- I can spot a slip and fall potential from like 100 feet away. I also know some folks who went in house for events companies (obviously not possible now)- big rise in adventure racing and multi-stage athletic stuff (ultras, marathons, etc.) so that might be another out for ID folks.
In house. If you’re at the stage of your career where you’re not going to take a crazy pay cut, going to the right place can mean stock, good opportunities for promotions, and the insurance defense lawyers are kissing your ass. My wife made that switch 15+ years ago and slowly climbed the ladder into senior exec roles. I’ve done both plaintiff and defense work and would take the plaintiff side over defense most days. All things being equal, the billing and dopey requirements tip the scales to plaintiff work for me.
Thank you so much for this insight! The in house role is very close to my current pay (with better benefits) and they said they might be able to do a signing bonus to close the gap until we get bonuses next year. That said, I still have two more round of interviews to nail. Fingers crossed 🤞
Made the jump from big law lit (insurance focused) to an in house claims counsel role and, at least in my case, the grass was 100% greener on the other side. Much lower stress, stable hours, laid back environment, no weekend work. I dont even have my work email on my phone which blew my mind at first. Certainly took a pay cut but it was more than worth it imo. Plus, all those partners you used to work for will be catering to you now haha
Thank you for this insight!!
