Can anyone familiar with this process explain to me the difference between the original and the independent? Does the first autopsy get thrown out? How do they know which is right? I’m unfamiliar on the topic.

I believe the lawyers on each side would have their respective pathologists testify, the judge would preside over what is admissible, and ultimately the jury would decide. Here is an example from the Peterson murder trial in 2012:

A1 - I know it’s difficult to imagine, but yes institutional racism runs this deep.
You can also have a lack of blood flow to the brain if you’re on drugs and or are drunk. This is established in the Criminal Complaint and is likely why he was being arrested. If neither report mentions petechiae, then it will be a turkey shoot in court.
He was being “investigated” for the forgery. But they wouldn’t actually arrest him on that. He was likely arrested because he was intoxicated and the driver of his car. (It’s established by the coroner he had fentynol in his system and there was recent methamphetamine use).

He’s not allowed to drive in that state and they would have had to arrest him. It would have likely all been tossed out by a judge the next day and he might have gotten a small fine.
I’m not justifying any actions. I’m just calling it as I see it. It should likely be murder 1. The intent was there after the I can’t breathe statements. But at the same time, there’s a lot of gaps in the criminal complaint that make this case not a slam dunk.
1) why did he claim he couldn’t breathe before he was in the hold? Was he having a medical episode?
2) when were the paramedics called? If they called the paramedics before they put him in a hold, it’s hard to claim their intent was to kill him as they had medical help on the way.
3) why is there a 5 minute gap in the criminal complaint where they go from him being in the car to him in the hold? What happened between 8:14 and 8:19?
4) if asphyxiation wasn’t the true cause, it could be difficult to get murder.
We need to ask these questions. Not to minimize the horrible action, but to prepare ourselves for what the emotional toll of the next year might look like as this case is fleshed out. The protests we see across our country rightly happen twice. The first time after the crime, the second when we get an undesirable legal outcome. Someone has to ask these questions. Police regularly cross the line in our country. But at the same time, we can’t just summarily put them in prison.
It’s actually scary seeing people justify the middle. Check out NY Times video they pieces together from bystander videos if you really need a second look
