I’m looking for advice re: billing. I’m a baby lawyer and just started at a firm that’s had a fair amount of turnover. As a result, I inherited some messy files where documents aren’t labeled. Sometimes it takes me 10 minutes to just find the complaint, searching through years of emails until I find it by chance. I know people on here say to bill everything, but how do I label that when entering time? Just loop it in with “review file” and hope nobody asks why it took me so long?

Or alternatively I would loop in the time with the specific assignment. Meaning if it took you 20 extra minutes to draft a stipulation because you had to find the complaint and answer, roll that 20 minutes into tje time you spend drafting the stipulation. But obviously best thing to do would be to have a paralegal or someone organize the file, rename documents, and put everything where it needs to be so you don’t have to search everytime you’re in the file

A1 is also correct. But it depends on the assignment, in my view. If you’re given something simple that should be a 0.5 even for a baby lawyer (your description) and you’re constantly billing 0.8-0.9, your supervisor might start wondering if there’s an issue. Better to be transparent on the front end, in my opinion, than sneak it in and only explain if confronted.

Thanks! I brought it up with a partner when she asked how things were going. She’s aware that the current system is messy but didn’t have any solutions. I guess we’ll see what happens when they review my time lol

You just need to work on using the right language in your time entities. I recommend the book The Billable Hour to help with that. It’s a short read but it really helped me.

My firm uses Clio and has some preset descriptions. What you’re saying smalls under Work on: locate x” or “review and consider: y” and when you’re asked why you bill for that, politely but honestly say: the system is a mess and it took me time to track things down.

If it’s as bad as you say and you don’t get credit for that time (whether or not it ends up on the client bill) that’s a flag.

Defer to your partners for phraseology (particularly if it’s something like insurance defense at a place where including an “and” makes your entry improper block billing), and see if they have phrasing they use to bill file management/organization (which can reasonably be younger associate work), maybe something like review and revise client files for xyz (deposition, motion drafting, or trial). Otherwise I’d wrap it to your task other. If you are looking for complaint for drafting an answer bill it to drafting the answer.

My firm has a collections budget (80% of your billable rate x 1850 hours) and an hourly budget that must be met in order to be eligible for a bonus. The firm cares very little about originations and will reward someone for making their collections over someone who brings in new work. I missed my collection budget due to some odd timing with a client, but originated more than all my peers so no bonus for me. I’ve been at this same mid level firm for 9 years and it’s all I know. Legal question: In a subrogation case, in order to prove the subrogee’s right to assert the claim, wouldn’t the subrogee have to introduce the agreement giving such rights? Without stipulation, wouldn’t the sub have to present the agreement to the jury?
