I'm trying to understand the political context of anti trust law. I'm a right leaning attroney and I don't see anything wrong with busting anti competitive behavior. I love competition. But I'm working on a matter and it seems that it's a very left leaning area of law which I don't understand why.

I think because it's highly regulated, mergers are sometimes prohibited, etc. I think the right-leaning/small government/libertarian perspective would prefer unregulated business, where companies can agree to fix prices or carve up markets if they want.

I think it's a nice reminder that just because you might fall on one side of the political spectrum, you don't necessarily fall exactly in line with the prescribed set of beliefs.

Just for context I'm free market but pro competition, I'm also pro unions as long as they compete. I think it's a way to get the government out of stuff.

Antitrust requires a lot of difficult predictions about the future in which judges are asked to either side with the government's point of view, or a corporation's point of view. Skepticism of the government means a lot of conservative jurists will side with corporations. Or, others conflate what is good for corporations with what is good for capitalism/free markets, even though those are not at all the same thing. Antitrust used to be much more bipartisan, for what it's worth.

Eh, I think it might be more "right leaning" than other areas of law. While American conservatives might be wary of the exercise of regulatory power, the doctrine and underlying theory basically forces practitioners to be economic realists. "Harm to competition, not competitors" and all that sort of thing.

Competition is everywhere. I think there’s a lot of space between “big is bad, break it up” and “no regulation” in a market. As you start to understand more of the complexities, you’ll likely see some regulations that do a really bad job enhancing competition in a particular space.

I’m left leaning on almost every single thing. Not this. And this is what I do.

In addition to what everyone else is saying, I think this is an area where people conflate conservatives and libertarians as "right," but they few fundamentally different approaches resulting in very different positions on the issues.

What do you mean by left leaning?

Liberal judges and circuits are more willing to entertain these cases than right. Or more importantly Scalia hated these cases.

You do realize that the right’s embrace of free markets is a complete myth? It’s all about deregulation and corporate welfare for those hypocrites.

That's probably true of a lot of people, especially those in politics. But no reason to paint with such a broad brush. This is like saying "the left's embrace of regulation is not about health or safety, but power over people's lives." Probably true for many, but generally not.

I’m a woman, 6th yr and I’ve always found it hard to explain or discuss anything orally and doing presentations for clients is a nightmare (I do well it just takes a lot of energy).
