Employers in the US are too afraid of getting sued if they speak poorly of an employee to another employer. But setting that aside, I don't really understand the reluctance to tell people. They generally figure it out eventually anyway. It just feels kind of rude to refuse to tell.
AA1. It is mainly paranoia on their end. I do know of someone that got their offer rescinded after getting blackballed. The old company took them back and essentially said, "we'll give you x months to find another gig." (The person gave his notice but wasn't officially offboarded yet.)
I am in the asset mgt industry and it is a small universe. That whole 6 degrees of Kevin Bacon thing, especially when you've been in a certain industry long enough. But you'd have to be a real jerk to go out of your way to bad mouth someone at their new place.
I have never heard of a US lawyer, staff or administrator calling to another lawyer’s firm to say negative things. I would be surprised at such a thing. (And yes, a good deal of what prevents this kind of behavior is the possibility of being sued.)
