Insurance defense work seriously undervalues the importance of sitting and just thinking about a case for an hour or so to plan the next moves or figure something out.

I feel this thread in my soul. Some days I feel like I’m more concerned with how to get my billing in for that day rather than moving a case along substantively.

It’s crazy to me how litigators let non-lawyers make the rules about what lawyers can and cannot do to defend a case well. Plus the way insurers can slash bills off is wild to me. If you hire a plumber and then start cutting line items in the invoice after he fixed your toilet, he’d sue. Yet insurers get to do that all the time to lawyers.

The insurance policyholders can sue too. If the defense firm is passing those cuts back to the policyholder, there is a case. I make my living suing big insurance companies. It’s fun.

Wow. Now I understand why opposing counsel can seem unreasonable sometimes. As a plaintiff’s attorney, I don’t even file a case unless it’s damn near a slam dunk. So I wonder why most defense counsel doesn’t do a better job of advising their clients to cut their losses.

Atty 4 - ins co doesn’t want to pay the plaintiffs. They’d rather pay defense costs and then right before trial pay what the pl has been asking for plus some

Why?

I don’t really care if they don’t follow advice to settle or get rid of the case. Fine, it’s not my money, not really my problem if it’s a runaway verdict. Doesn’t cost me anything. And I certainly understand that it’s a business and a numbers game. Fine.

But if the case is trying or is likely to try, don’t hamper my ability to fully prepare and go to war against armies of well resourced, sociopathic killers who aren’t bound by anything - including the facts, law or the truth. Either go to war. Or don’t. Don’t send me into a gun fight armed with nothing but a bag of dicks

I have a question for those who prep individual tax returns. My parents claim my grandfather as a dependent on their tax return and due to their low income, receive PTC for the premiums they pay on his insurance (not eligible for medicare). However, would it be advantageous to have him file for his own tax return (he stays with my parents and doesn't have his own proof of residency via bills). If so, can he get PTC if his income is 0?

The amount of people, even attorneys, who can't separate out the policy merits of abortion from the issue of whether it is a constitutional right is disappointing. I consider myself pro-choice ---I believe states should allow it, that the federal government can pass a statute to guarantee it, and that FDA statutes and regulations will preempt any state trying to ban chemical abortions through FDA approved drugs. Dobbs at its core is a case about the Due Process Clause, not the policy of abortion
