Review your state’s fee splitting rules since you would not be an employee. Make sure you are in compliance. Also, consider the tax consequences, malpractice insurance (which may be harder to get in your described situation), and other costs to being your own business. I was an independent contractor for awhile when I switched from government to private practice and the taxes were stunning. Ask what will be provided: case law system, software, support staff? Do you pay for your own printer paper, for instance? In theory, it should mean you can decline assignments and work when/where you want. Make sure that’s accurate. Also, consider how you will back up your own system, ensure no interruption if your computer breaks, etc.

It depends on the type of work, how it is billed, and other variables. Is it 50% of gross or net? 50% of what is billed or 50% of what is collected? Who sets the fee? I’m not sure I would do a commission. You could end up doing a lot of work for “free.”
