Is anybody inserting extraordinary supply chain shortages/delays/disruptions in their Force Majeure clauses and having luck with customers accepting that language?

Yeah we strike that type of language. If the shortage/delay is due to a force majeure event (fire at the supplier facility for example) then performance may be excused but a shortage/delay is by itself is not enough to excuse performance in our opinion.

It’s in our boilerplate, not messed with 90% of the time. But when struck, I agree to remove for the reasons covered above.

Just saw an ad for Kesimpta for MS and gotta say, one the most predicting fair balance lines I’ve ever heard. “While no cases of PML were reported in RMS clinical trials, it could happen.” Wow. Massive government overreach. Clinical trials are now irrelevant when it comes to any class effect. And yes I’ve been doing this DTC thing since it all started.

I’m itching to move to NYC so badly, but I have a few concerns and would love advice.

I just moved to NYC for the first time. One question: Why isn't 5th Avenue called 9th Avenue? Who came up with the stupidity of using random named Avenues in addition to numbered ones, or is it well thought out and I just haven't wrapped my mind around the brilliance.

My company has no CLO or GC. However, my company runs all in house legal opinions through its CCO, a non attorney. The CCO and I have had disagreements on points of law on several occasions, but regulatory actions have backed up my opinions. Regardless, the company values the layman's point of view more than mine. I do not feel appreciated by this company in my current role.

Considering an offer to go from firm (4 YOE) to become a privacy/product counsel for a tech company (non-faang). One concern for me is the potential of a recession in late 22 into 23 with the fed rate hikes. My fear is if that happens, me being on the chopping block as new in house counsel. Has anyone gone from small real estate development company to big REIT? I’m being told that hours are the same (if not less) at the REIT, but I find it hard to believe. In my small company now, I frequently work after hours and take calls from the owner outside of normal business hours.
