Is it okay to call a “Memorandum of Law” a “Brief?” I am not a fan of it but have seen people do it. Yay or Nay?

I use memorandum of law when I’m filing a trial court motion that involves a detailed analysis, such as a MSJ or MTD. I usually file a short motion citing the applicable rule and summarizing the relief that I’m seeking and then attach a memorandum of law to the motion. I only use “brief” to refer to the bound thing that you file on an appeal that your supervising partner says shouldn’t take more than an hour.

I usually see "Brief in Support of []'s Motion" rather than Memorandum of Law, so it may be a matter of local custom.

Agreed that it may be local custom. My firm titles theirs “[atty name]’s Memorandum of Points and Authorities in [Response to/Support of/Defense of] [Pltf/Def]’s [rule #] Motion....”

So in practice it would be “XYZ’s Memorandum of Points and Authorities in Support of Defendant’s Rule 12(b)(6) Motion to Dismiss”

The firm I’m at uses Memorandum of Points and Authorities in Support of [blah blah].

I don’t think any right or wrong way as long as the court undersdands

Only appropriate in appellate/sc briefs. Every other motion should simply be titled “memorandum of law” dressed up in whatever way is appropriate depending on the given motion. Unless local rule dictates calling it a brief...

Yeah but like I would label it Memo of law then if I'm citing it see P's breif in support. But they're pretty Interchangeable.

Depends where you are. Some states have rules that differentiate between the two.

Depends on the jx. The states I practice in call it anything from “brief in support” to “suggestions in support” to “memo in support”. Check local rules and see what terminology they use.

Our state rules call it a memorandum of law so that’s what I title it but internally I call it a brief

Waiting now 13 months for a decision on a pre-answer motion to dismiss for an employment/business law dispute. Been administratively adjourned eight times and bounced around now two judges. The applicable law is straightforward, requires some reading but nothing heavy lifting, so it should not take this long. Of course client is livid, but what can I do? I authored all of the briefs in a 9th circuit appeal. My managing partner did the oral argument. Opinion was issued today; and we lost on appeal. The decision was issued as “for publication” opinion. Do I add this case to my Resume/CV list of published opinions? Yes, we’re on the losing side (we lost below too; we were the appellant); but it’s still a published case where I was the brief writer. Would you still “claim” it on your Resume/CV as evidence of your appellate experience?

If you use Google Chrome, I highly recommend you download the ProKeys extension and implement it into your billing practices. You can create “snippets” (abbreviations) for template billing entries and auto-populate the full text just by typing in the snippet and hitting a hot key. The extension functions anywhere in your web browser (but you can disable it on certain sites if necessary.)

I’ve been extremely busy. Because of this, I have less patience for the constant follow up required for me to get things out the door (I’m talking about weeks of unanswered e-mails and phone calls). I have been finding it difficult to raise the issue because everyone seems appreciative and many partners (including the ones who are causing the unnecessary stress) go out of their way to tell me what a fantastic job I’m doing. At what point do you begin to feel numb (if ever) when you’re done trial and prepping for another trial in a span of 3 months, while mains full caseload of other active litigation cases? Should I be worried that I’m going from engaged and stress to numb and slightly indifferent? Or is this what it feels like to power through? I can’t gauge it anymore? And can’t impose judgment one way or another either.
