better not to show and describe generally if you can
Don’t know any formal rule. Its more of a judgement call to me. Main considerations are avoiding possibility of contaminating the witness - meaning inadvertently influencing witnesses memory or impartiality later - and avoiding appearance of impropriety or improper investigation. I resolve such considerations by defaulting to not showing unless I have a very good reason to. Further, there are ways to frame questions where you can test and explore the witnesses relevant knowledge about crucial topics in emails that are unfamiliar to the witness without divulging content or contaminating the witness To summarize, you tend to have more to lose than gain by doing so - so you need a compelling reason before doing it
Thanks both! Very helpful insight.
