Is there anyone who is a med mal attorney in the New York area? My niece went to the hospital complaining of abdominal pains, the hospital sent her home and said she had food poisoning. The pain persisted, she we to another hospital where they did MRI and found two large ovarian cysts. She had emergency surgery same day. Does she has a potential claim?

Potentially. It depends on the standard of care of what a reasonably competent physician in that geographic area would have ordered. Sending her home without any radiologic diagnostics seems negligent. Did they take any x-rays at least?

If there were medical issues related to the delay, prolonged healing, pain and suffering, loss of consortium, and any increase in medical expenses attributable to the delay. You’re not going to retire on the case, granted.

Technically yes. Practically no. Limited damages due to the relatively short delay.

Man I wish my parents would have sued when this happened to me as a teen. I’d gone in several times for abdominal pain and was sent home after being told “girls get cramps. Take some Motrin.” Eventually it twisted- cutting off blood supply and I lost an ovary. Had to do fertility treatments to get pregnant because of the damage that caused.

Lender shopping before I close out on my first home. Is 3.5% a good rate for putting 20% down on a home? How can I go about having my lender match other lenders? So I posted a bit ago about getting IV hydration and vitamins. You guys gave me the courage to try it. After I had it done, I didn't feel much of a difference and figured I just spent a bunch of $ to relax for an hour in a massage chair. 🤷🏼‍♀️ But this has been the best week I've had energy-wise in the last seven months. And I kind of wish I could post before/after pics because apparently I was very bloated. I've been focusing on keeping up with my hydration at home. Thx ladies!

Edward Jones advisor with 30 million AUM and roughly 250k gross production. Been there for almost 4 years. Got an offer at Merrill Lynch to take over a 100 million dollar retirement transition plan in 5 years, or to join a 5 person Merrill Lynch team that manages a lot.

Pros to EJ: Have my own office, a year or two away from partnership, great office setting and client satisfaction.

Pros to Merrill: Bump in compensation, additional tools and services w banking, ability to take over assets.

California attorneys — I am having difficulty finding authority concerning the use of a rejected (partial) settlement offer to claim that a party failed to mitigate their damages. I.E. plaintiff could have mitigated if they accepted the (partial) settlement offer. Defendant offered to settle one claim (without affecting the others). Plaintiff rejected. The value of damages has increased over time and now defendant claims that plaintiff failed to mitigate because they did not accept the offer. TY
