I know I’m not the first or last to point this out, and that you and all of us recognize it, but be happy that you’re still a lawyer. I’m laid off after tomorrow and I’m already missing the purpose and the pain.

Launching an apparel brand with my cousin! I’ve always been more business savvy, and she’s a graphic designer. I’m primarily a civil litigator, but I’m thinking about switching to another firm where I’ll be doing transactional work almost exclusively. Right now, about 1/3 of my workload is transactional and the rest is litigation. I find transactional work to be fulfilling, but I wonder whether I will miss litigation. To all you former litigators out there, are you happy about transitioning over to the transactional side?

A partner I work for has a long- term associate who has been and solely works on on all of their cases. I am new, and any case they have me working on they pulls the other associate into. It feels really frustrating because the other associate takes over and I am not sure what to do. They frame it as we are a team however they keep me out of the loop on many other cases i work on. Associates in midlaw and smalllaw, what is stopping you from attempting to lateral to a biglaw firm?

TM litigation/TTAB: generally, I know you can't offer your own witness's discovery deposition testimony as evidence at trial except in certain circumstances (e.g., the witness is unavailable, need to complete the record in fairness etc.).

But can you attach your witness's prior dep. testimony as evidence (exhibit) via a SJ motion or opposition to a SJ motion even if none of the exceptions apply?
