To be clear on the law, it’s NOT illegal to ASK these things, but it is illegal to make these factors part of their consideration of hiring you or not, for obvious discriminatory reasons, so it makes more sense to not ask at all about pregnancy, sexuality, race, age, etc so there’s no rick if bias coming up when hiring, intentional or otherwise. I don’t believe there’s a law about discrimination against parents, just pregnant women and women (or gender) in general. So technically it’s not illegal to ask you about kids or your family. But like everybody else has posted, it’s absolutely shitty. If you get to the point if almost getting an offer or have an offer withdrawn, and it seems to be because you have kids, I would get a lawyer involved. Even if you just get a small payment for the trouble (I wouldn’t want the job after that) it’d help make the pint that this kind of discrimination isn’t okay. Mothers in particular have been hurt a lot during lockdown because of shit like this. Some legal proof that it won’t be tolerated in the bigger picture would help.

We have given all our our parents at my agency the ability to work around their kids schedules. Find a place that supports your mom duties. They are out there! I would never ask in the interview process but I hired a woman with these issues during Covid. She brought it up and we gave her 3 hrs out each week so her husband can do his client conference calls so they could tag team.

I’ve been interviewing and I do not mention children. It’s not part of my dedication or abilities. It’s something I deal with and you will too. This is against women 100% and it stinks. I’d keep it quiet. Let them focus on you and not your motherhood.

Same. I mentioned it once by accident and quickly brought up my full-time nanny who doesn’t exist.

Strongly urge you not to mention it. Child care has been a pain point for so many agencies, and I’ve been in meetings where senior leaders and HR have talked about how that impacted which employees were furloughed. Even if it’s illegal, it’s happening. Also, I had an interview last week where an agency head straight up asked me if I have kids.

I have no advice. I just want to say I’m so sorry for the position you’re in. It’s hard enough to be both a mother and dedicated employee in the world we live in and adding a pandemic to the mix just makes it seem impossible.

Don’t mention it, I don’t think jobs are allowed to ask about private situations (partnership, kids, sickness, etc) if not related to the job? Practice responses that don’t involve kids in which it may slip out, such as when asked what you do during your free time.

Having kids is like having a car, a pet, an outdoor space, a good singing voice, or a food allergy. As in, totally normal and not necessary to mention in a job interview. They’ll find out eventually when you want to bring it up.

It’s illegal for them to consider your parental status as a condition of your hiring. No need to disclose.

I actually would recommend that you DO bring it up. I was in a similar situation and mentioned on interviews the struggle I was having with kids at home, only because I wanted to know if the company I was going to work for supported working parents. I think it’s better to know up front rather than deal with the consequences after accepting a position.

I think asking questions about your personal life is illegal. So treat offering info about your personal life the same way. You will do a fabulous job despite being in a challenging balancing act. Also You will absolutely not be alone in this challenge at any agency/company. So once you get hired then you will make it work and they will make it work for you.

If you are just looking for a job to get out of a current job - don’t mention kids or anything else that would technically get in your way of doing your job. If you’re looking for a long-term move and you want to make sure it’s the right place for you (e.g. a comfortably environment to be a working mom) then sure mention the kids and the challenges of full time work + WFH.
