Generally the "lifetime" of paint for rental properties is 4 years. At least where I live, you can't be charged for the cost of painting if the residence has been occupied for more than 4 years. They could potentially charge you for any holes in the wall that are beyond wear and tear.

If I were your roommate I’d be mad if you didn’t discuss this with me or have some kind of agreement before you made this decision to not pay rent.

To answer the question that was asked, yes you are a terrible person.

Thanks P1 for the most efficient answer

Didn’t they check the place out before you taking over the lease?
I don’t know, you should talk to a lawyer or something. Maybe talk to management about it. You’re avoiding paying because of an outcome you aren’t 100% certain will happen

Does the management team know you took over someone’s contract? There is likely some language in the lease agreement that discusses this situation. Also you should know most lease contracts are setup so that the security deposit will cover the damages first before covering rent. So if you don’t pay your last month rent your security deposit may not be able to cover it and you will wind up in collections
I assume you want no future friendship with this roommate?

My apartment said it was fine to hang things up, paint, etc. Just put a little spackling over the holes if they’re bigger when I leave, and I’m good to go.
If it’s truly just paintings and mounting the TV that is “damage,” I would say pay. But are you actually entitled to a refund of the security deposit, or is it in the original roommates names?
Chief
Yeah I am entitled to the refund. The thing is all I know is what I signed up for when I moved in. I don’t know what this place looked like 5 years ago.
Rising Star
Yes, doing this without having your room mate buy-in does make you a terrible person. You knew the state of the apartment when you moved in. You accepted the terms. Now live up to what you signed.
They likely did not come check it out, but when you take over someone’s lease you should have done the due diligence to check out what you’re signing up for.
With that being said, it sucks and I’m sorry you’re in that situation.

To add I took over someone else’s lease. I’ve lived here since December lease is up 8/30.
Rising Star
Just clean the place and spackle. Grab a can of paint, it will take a half day.
Chief
I’ve never done more than spackle and haven’t had a landlord charge me for paint. OP YMMV so read the lease.

Update, she moved out before the end of the lease and moved away to another state. She left her belongings here until the end of the lease and had her friend (who is local) facilitate her move. Our management company asked us to sweep and fill in holes in the walls left by hanging items/shelves and the security would be returned. Her friend and movers came yesterday they didn’t sweep her room (the floor is disgusting) and didn’t fill in the holes left in any of the apartment walls.
I’m glad I didn’t pay the last month.

I’m glad you discovered your word is worth less than a month’s rent.
