Some people just suck. I feel like I always have at least 1-3 cases where opposing counsel lives to make other attorneys miserable. I think some people use it as a tactic; which is misguided imo.
Never underestimate how miserable people in this profession are, and how much they enjoy making other people as miserable as them. Because it's so much easier than putting the work in to be happier themselves. We swim in poison.
Assuming that there’s no exigency that’s necessitates this setting he or she may be trying to force a settlement or other compromise, with the court’s tacit assistance. I once had a federal judge set a five day jury trial for Monday, December 23. Doing so precipitated a large minute settlement driven largely by counsels’ bilateral fear of being forced to greet the jurors on the third day of trial with “Good morning ladies and gentlemen. I’d like to wish each of you a Merry Christmas.” Or OC doesn’t celebrate Christmas. Or he or she is just being a jackass.
Based on my limited exposure to the case, the answer is definitely the later.
I hope that’s a small percentage of your caseload, but you’re right. And there’s rarely a tactical or strategic upside to doing stuff like this. Just wastes time and money. Good luck with the person and don’t let his or her bad behavior drag you down a level. Always do it right. Hard, but right.
