If your H-1B application was not selected and your status is now “submitted”, but your OPT expires in July: Could you stay/work in the US until end of September (cap-gap rule) as we might have a second lottery? Or are you not allowed to work with your “submitted” status after your OPT expired?

My company misplaced my official approval notice since I transferred right around the beginning of the pandemic and we went into a lockdown. I have recently got an H1B extension i797 approval and my spouse have received an approval for her H4 extension (i539). Do we need to get a VISA stamped to re-enter US, if we plan to go to India or i797 approval letter would work?? Please help

Can some one help me on this: My PERM was filed in 2011 and I have approved 140 from previous employer. This morning I saw that priority dates are moved. To get EAD, should I have my PERM filed from new employer first or can I use my old PERM and 140 from previous employer?

Is there any room to ask firm to expedite my GC? It has already been initiated by law firm. Got an external offer but firm leadership really want me to stay and asking for my demands. How can I take advantage of this to help my GC?

Can someone explain very simply in their own words what the steps of going from H1B to GC is? I googled it myself but just confused about the forms associated with each step (I-140, I-485, etc.) and the approx time of each step. So far my firm has extended my H1B a month ago and while doing so asked me to briefly describe my job duties for the PERM labor certification application. Does that mean the GC process has been started? My h1b is till late 2024. What kind of timeline am I looking at?

My firm just filed my PERM application. My H1B expires (6 years) in June 2023. Should I be worried ? Assuming that PERM takes 6-8 months and they do a premium processing on i-140 by lets say Feb/March, does that look like sufficient time? Also will I be elligible to get a 3 year H1B extension versus 1 year ?
