Just learned my agency doesn’t pay out unused accrued PTO. Is this legal? (NY based)

If you have unlimited PTO it’s completely legal. That’s one of the scams of unlimited PTO.

Was never paid out for my unused days (also in NY), would have been nice when I didn’t use 10 of my days a couple years ago.

Been at 4 NY agencies and not a single one paid out. Just a trend they all use to screw us. It’s in the contract you sign when you start so there’s nothing you can do at the end.

Would love to see the verbiage in any of the contracts you’ve signed if you still have them…

When I got laid off from my NYC agency I didn’t get paid for any PTO. They thought paying me until the end of the week (it was a Thursday) made them sooo saintly. They let me keep my company phone though 🤡.

So gracious of them.

For those companies / roles with unlimited pto, how does a payout work if you leave and /or are laid off? Receive nothing or some set amount?

I work in a group that has had to come in to the office regularly during COVID (lots of work with original documents and wet ink signatures). It’s real estate and title companies still require wet ink documents. One junior has refused to come in because he says he’s concerned about COVID. We all wear masks, close our doors, and socially distance. We’ve all had to pick up the slack for him. Just found out he’s taking his second vacation during COVID and visiting family in FL. I could scream.
