(Kind of kidding kind of not) Am I the only one who is just itching for a good fight? Not some little “Who’s going to get the beach house” but like, a good knock-down drag-out hearing over custody. I had my first in-person hearing since March yesterday: an Order of Protection hearing yesterday that had some fairly extreme abuse-related facts and it just felt beyond exhilarating to get in there and fight to protect a poor mom and her kids. I’d almost forgotten what it was like to feel alive...

I find that, more often than not, litigation is a disservice to clients. At least where I practice, fully litigating a divorce, for example, is $100k or more in fees. I had one case that approached 7 figures in fees alone. Most of my clients can take the hit, but from a cost benefit analysis, that money goes to much better use in the family's bank accounts. I'm very open with clients and opposing counsels about this from the beginning. I know a lot of opposing counsels in my jurisdiction don't value the economics of the divorce and family law matters so it leads to unnecessary litigation. That only hurts the clients. They spend too much money on fees, are in an overly adversarial process that affects coparenting for years to come, and drags out the process. Our judicial system was not built to decide most family law issues.

I love the experience of taking on an adversary and winning. I hate the experience of being taken on. In family law, both happen regularly and it is a rollercoaster. But there is no better practice for forcing an attorney to think on his/her feet, for using emotion as well as facts and law to make an argument. When you have the facts on your side it’s great!

Nope. I’ve been to court with my attorney on it, sat in on mediations, handled more than my fair share of family drama. It’s emotionally wearing after a while, especially if you’re married or have children of your own.

Had my first hearing today since shelter in place orders went into effect 2 months ago. Things got spicy during the hearing and HELL YEAH! So invigorating! Feels like I came out of a coma.

I do family law through our local Legal Aid now for exactly this reason. I got tired of fighting over people’s wedding China and vacation house in private practice.

I understand what you are saying.... if I haven’t had a contested hearing in a while then I get super excited if I get to go to court for a hearing on orders of protections or temporary issues. I feel a great sense of accomplishment and I enjoy the process of preparing exhibits and witnesses and going to court and presenting my case. I wouldn’t want to do it frequently because it is tiring and not all clients can afford the cost of litigation but I get enough trial time and it’s awesome!!!!

If I don’t have enough cases going to hearing in a while, I’ll even do a order of protection case pro bono or for reduced cost so I can go to court and fight.

I miss real life court....was so stressed out pre-corona, never thought I'd miss it....but I'm missing the courtroom, too!

I'd want to modulate how excited you get about there being crossing allegations of abuse and how "fun" having a no holds barred, bare knuckle courtroom brawl is. I'd want to be careful how excited I would get about facts being heinous and conflict being high.

Every statute related to family law dicsusses that the "best interests of the children" are paramount. If you're excited about serving the best interests of the kids, that's great. If you're excited about the victim hood of those kids and how fun the courtroom brawl will be... You might want to look at that.

Remember, it’s your case and not your divorce. It’s also your long-standing reputation with courts and counsel. Present evidence objectively and not hysteria. I’ve handled family cases for over 25 years. The attorneys itching for a fight are generally not well received by the courts in my midwestern area and I believe their clients suffer as a consequence.

Consulting is the least stressful part of my life. My relationship is at a very low point (unexpected loss on his side) and I am the target of a lot of anger and emotion.
