If referring attorney called after you left and you did not solicit anything from him for your new firm while you were at the old, there should be no problem. It’s called competition.

What's he threatening? Was he referring cases to you? You did nothing wrong, and did nothing against your own firm. A referral source isn't a client.

I'm sorry that you're in this situation. Some attorneys can be real jerks.

It doesn't REALLY matter, but was this referring attorney referring all leads to your old firm, or was your old firm one of several? If it's the former, then obviously the old firm considers you a threat to their existence.

I think the only advice I'd give is to have a chat with the referring attorney about it, if you haven't. He/she needs to know this is going on, because they obviously had a reason to start referring cases to you, and maybe they can smooth things over, either with old firm, or at least by making sure to let it be known why they made the decision.

It's a market. Markets involve competition.

Did you have a contract? Some pi firms cover themselves in this exact scenario by getting you to agree up front that if any firm referral sources send you cases after you leave, you have to kick a referral fee back to the old firm (or something along those lines). If you didn’t agree to that, then what can they do other than try to bring some kind of tortious interference case just to jam you up?

Sounds like it’s just sour grapes and a petty person you are Better off distancing yourself from.

I know people who have been promoted to partner who have for a fact been given poor reviews bc they are egregious managers — some are not even respected by juniors because they also don’t have much substantive knowledge. I currently work at a small PI firm in Atlanta were EVERYTHING is settled presuit. If we’re unable to settle, then it’s referred to another firm for litigation. This whole process seems very atypical to me and the attorneys rarely touch a file until the first liability offer is received. The paralegals handle everything from intake to drafting the demands. The attorney briefly skims (does NOT read) the demand packages and signs. Is this ethical?? Anyone else work at a firm that is run this way??

Should a company go out of business if it hurts consumers? 3M is facing lawsuits for their defective ear plugs, surgical blankets, firefighter foam, PFAs, etc. Someone just got $77.5 million on 1 earplug case and there are about 270,000 military personnel with tinnitus and hearing loss. At least 20,000 people who have had multiple surgeries from their blankets and some who have had limbs amputated, who knows how many have had cancer, etc from chemicals made by 3M. 3M market cap is 87 billion

Spent a long time working for a reputable insurance defense firm before switching to plaintiff PI. Recently let go from plaintiff PI firm due to pandemic financial cutbacks. NY specific question: my last firm paid for case tracking through elaw. I’m joining a new firm with active matters but no elaw account. I see that ecourts has an “etrack” feature. Do I need elaw? Or can I get appearance notifications etc automatically through ecourts? Is there anything that elaw does that ecourts does not? Thank you!

New to PI. I filed suit and know policy limits ($500k). I want $1M but I have to live in reality. Insurance company wants to know if I have a demand. Is there any reason why I’d demand more than the policy limits?

How difficult is it to start your own PI firm? I'm sure there are countless lawyers that start their own firm, fail, and go back to working for someone else. But most PI lawyers I know were able to make it on their own.

I am looking into starting my own firm with one other attorney. I have never been a partner or solo so I am trying to figure out best practices right now. For Plaintiff PI Lawyers, what is your "pitch" when you speak a potential new client who is looking for an accident attorney? Especially if you're a younger attorney, who can't make the "I have over 20-30 years of experience, have seen it all, won X number of cases and recovered Y amount of compensation for my clients" pitch. I explain the process, say that my firm has an amazing team, that I will keep them updated every step of the way. Is there anything else I could say to land the client?
