Maternity leave in NY state: does anyone know the complete breakdown of state-mandated leave? It seems there’s an initial 6 weeks and then another 6 weeks - but I can’t figure out what’s paid, partially paid, etc. Any guidance from someone who’s navigated this before would be amazing! (My firm doesn’t have its own policy)

NYS also has a paid family leave - bonding with the baby. It’s unpaid by the employer. NYS pays 60% of your salary but it is capped pretty quickly. As a reference - I took it this year and got $840/week, the max amount (you get the checks gross, they are not subject to NYS tax but subject to the federal tax). I know some companies use NYS leave to offset their expense of paying for the maternity leave but that’s really shit. If you are in a unique position to help develop a parental leave policy, I would advocate for 12-16 weeks of fully paid leave for both mothers and fathers, for both birth and adoption, and then permit taking NYS leave on top of that - again, there’s no expense to the company but they are legally required to keep your job while you are on that specific leave.

I’m only the second employee in the firm (until now they’ve hired everyone as independent contractors) so they have no policy - but good idea to maybe use my pregnancy/maternity leave to suggest that they implement an employee-friendly policy for the future

It’s 12 weeks at 67% your pay, capped at $971.61 per week. You can use it to top off your company’s leave. I had to submit a claim for it through my company’s insurance portal. If you don’t have any company leave I imagine you’d apply directly through the NY gov website.
