👆be very careful about that. Most people are bound from noncompetes and cannot engage in such conversations after going to another firm.
They are difficult to enforce and below SM at most companies, aren't in place.
Manager at my firm got sued $2M because he opted to go independent and came back to work for the same client 6mo later. Another SM got sued $15M because he left to join a niche firm but took a client with him. Not saying it's not possible or that it doesn't happen, especially at Consultant level, just saying be careful and make sure your i's are dotted and t's crossed.
Did they win?
Usually these things settle and there is a cease and desist. In California these don't hold up. I've seen an MSA used but never litigation. At SM and partner its bad practice to do it.
I agree, it is important to do your homework but most non competes have a lot of holes and particularly when independent, most judges won't stop you from making a living.
