My company hasn't filed my H1 B petition yet. They're saying they filed LCA with level III wage for my BA position What does that mean? Will they have to wait to get LCA approval to file for petition? Anything I should be concerned about? Are we too late in filing? How does this wage level work? I have so many queries and I am so nervous at this time. Please help

1. All H-1B cap subject petitions must be filed by June 30. 2. LCA (Labor Condition Application), is a form filed with the US Dept. of Labor. It’s an attestation that your employer is going to pay you the prevailing wage, or higher, for the type of position you will have in the location where you will actually be working when the H-1B petition is approved. 3. “Wage level” refers to tiers of wages for a particular category of professions in a specific location. These are literally the prevailing wages based on education and/or experience. Wage level 1 is the low end; 4 is the highest. In the H-1B context, wage level 2 is the prevailing wage for a job that would normally require a bachelor’s degree (generally speaking). Depending on the job location, the wage may be higher or lower at the same wage level (e.g. Wage Level 2 for an Accountant in Los Angeles County will probably be higher than Wage Level 2 for an Accountant in Riverside County). 4. As already mentioned above, it takes about a week for an LCA to be “certified”. It’s filed online with the DOL. 5. Nothing for you to be concerned about right now because your H-1B petition hasn’t been filed yet. Besides, even if there is anything to be concerned about right now, nothing you can do about it. The immigration attorneys your company (presumably) hired will deal with the problems.

Are you first time applicant for H1B? You need to receive the LCA before you can apply for H1B. It takes between 7-10 days for LCA to come back.
