Payback agreement? I am Indian, not getting the green card anytime soon. Anyone has experience with payback agreements?
I've seen cases of liquidated damages clauses for the legal fees associated with your visa application etc. Not entirely common, but wouldn't be surprised if they're used enough. And yes, they're enforceable (depends on the state and nature of the clause), but may want to talk to an employment law expert on it.
I heard firms enforcing it when the person went to a direct competitor (e.g., Deloitte to PwC). I am guessing if you are heading to the client side they might wave it. In any case, try to negotiate with your future employer if they can pick up the tab.
How much you need to pay?
Upto 10K is what I have seen / signed. - Legal ? : Yes - Can they enforce : Yes, n they will - How to avoid paying it ? : Negotiate wit the new Company / Use the joining Bonus.
Thanks it doesn’t say how much. Just says cost to apply for green card. But I also know that applying for an i140 has to be done by the employer otherwise it is application of employees salary. But thanks - will check with all another lawyer
Ask Talent what the cost is.
I have few friends in barclays and jp who had similar clauses. But all of them left coz they just got i140 and not gc. Check your clause and there might be some wiggle room as you aren't technically getting gc.
I paid for my GC process, legal fees and every shit. It’s similar to paying for your dependent. But yeah there wasn’t a payback agreement. Ask your paralegal, get the agreement reviewed by another lawyer and then sign it. Also negotiate with your future employer to pay it.
