My former firm lost a multimillion arb in a case I was handling prior to my departure. I recommended against trying the case, but still find myself oddly plagued with guilt for the client. Anyone experience something similar?

Losing a decision in a regular case is nothing. It’s money. Honestly don’t lose a minute of sleep anymore. Losing a pro Bono case where our client was sent back to a country run by people that will likely kill her or her family when she gets back because some POS bureaucrat took an insane political position? THAT gets to me.

This. I’m on a team that is probably going to lose a pretty big case at the end of the year. I care, but I don’t lose any sleep over it. Our client will take a financial hit and then recover. But I have a pro bono client stuck in Kandahar right now (SIV applicant) who is trying to get evacuated ASAP. He’s the only client I have who keeps me up at night because I know there is a very, very high chance he won’t make it.

When you learn how to harden yourself against feeling like that, please share. I lose sleep over lost summary judgment motions no one ever thought we’d win.

Well, you can at least tell yourself you were probably right, if that helps, especially if there were reasonable settlement options. Depending on your feelings toward that boss, the vindication might start outweighing the guilt.

It’s not the firm’s decision whether to try the case. Sometimes it’s not possible to settle a case. Sometimes the client disregards it’s lawyer’s advice. Sometimes a party misplays the negotiations and has to try a case it could have and wanted to settle. Stuff happens. If you made your recommendation clear and someone didn’t heed it you should sleep easy. No one died. And hopefully no jobs were lost.

Is it ever appropriate (assuming you two are not close but are friendly) to vent/rant to your career manager about your project? They are the ones that can help you since they’re in charge of your staffing but it may hurt your career advancement in the company.

If all the top consulting firms made anonymous decks or gave anonymous pitches to a client, eg no branding and the client did not know which firm made which deck, do you actually think that the client would prefer MBB?  Is MBB actually coming up with better/more innovative solutions?
