My office recently offered incentives to all applicants but one, who happen to be a racial minority. All others are white male. I know all are qualified. Should I report this to D&I? It’s a bad look.

Yes. Report it. It will be up to D&I to decide if it merits a penalty, but if you felt there was discrimination then it should be reported.

No. You should continue to focus on your job, and not worry about who is getting offers.

In addition, you do not know all of the facts as it relates to the applicant's offers. This is a leadership decision, and impeding/interfering on this progress by filing an ethics complaint will most likely just put a bullseye on your back.

Reasonable degree of mathematical certainty?? What kind of standard is that? I’m a lawyer and it’s the first time I’m seeing that 😂 Man, even defendants only need to show reasonable doubt. When does anyone have that type of proof or information, unless they have a memo that literally says - let’s discriminate against the minorities. That kind of direct evidence is incredibly rare. Can you imagine if people waited to have that kind of proof how many of these subtle acts would go unreported or ignored.

First of all - maybe Paychex should read a book about employment discrimination. Many - honestly if not most - cases are based on circumstantial evidence - which can be used to show discrimination. And the minority here being left out, especially if there is no legitimate non-pretextual reason by the company, could be perceived as an adverse action.

You’re right that the OP likely doesn’t have all the facts, but neither do we to be requiring “mathemical certainty.” We also don’t know what the procedures are at OP’s company for raising a red flag for this type of behavior, and it also may not even require a complaint or anything more formal. Many HR depts and development depts allow for this type of anonymous reporting exactly for the reasons OP is hesitating - they don’t have all the facts, they see something that concerns them, they can report to someone else who can investigate and determine the facts when OP can’t.

Also again, I’m not trying to change the outcome, and I don’t say for sure this is discrimination at all, I just think the decision may unintentionally make the company look bad, and maybe the D&I can work with leadership and HR and give one more incentive to the poor guy who didn’t get it.

OP, I think how you said it now is the right way to approach the management. They may get defensive if it reaches to them as a complaint. But, a conversation on D&I and also that the person is above middle of the pack and deserve to be treated that way would go a long way. Thanks for raising an important issue.

Go with your gut. You don’t need to make a huge deal about it but raise the issue, let HR make the call. You’ll sleep better at night

Agree with this - raise it as a point not an accusation. It’s up to HR if they do anything, but chances are, they’ll be more thoughtful about D&I in the future as a result - and they can own the outcomes if it truly is a qualification reason and not one of unconscious bias / unequal opportunities for success. You don’t know the full picture but can certainly raise something like this in a sensitive way.

If it makes you feel more comfortable, call into the anonymous hotline.

When you say, less work planned for you. Can you elaborate?

Is this consulting or another industry? Who sets this work? Who decides which applicant is placed on the work? Did this person have more work previously and it's now pulled? Does the work require specific skill sets? Is all the work for all applicants the same?

To elaborate, there is limited incentives for 5, but there are 6 people applied, so the office gave to the 5 who happens to be white male, and told the racial minority sorry we have limited incentives, we think you qualify, but we have less workload we plan to assign to you, so we can’t give you the incentive.

Report it with well organized communication. Meaning, explain what you just said, acknowledge what you don’t & do know.

This is valuable to report and if they mess with you because of this, then maybe it’s not somewhere you want to work with.
