If my sister puts in her two weeks, can she claim unemployment (tho technically she wouldn’t have been laid off)? If she continues to WFH despite her employer’s policy and is fired, can she claim unemployment? This is a crummy situation and I’m wondering what the options are. Thanks!

A2 an employer would have a hard time defending that claim if she was fired. Usually it has to be for cause to fight unemployment.

Tell her not to give notice. Email that she won’t come in due to health concerns and high risk family members. Yes if they fire her she can claim unemployment.

Encouraging WFH is not the same as making it mandatory. People who “take the option” of WFH will be frowned upon. Meanwhile “encouraging WFH” alleviates the liability of the agency. Don’t fall for it.
