Talk to a lawyer, difficulty to evict varies greatly by city. They may suggestion a different option. For more difficult tenants I let lease renewals go month to month and terminate if needed. Here its a lot easier to get someone kicked out for overstaying expired lease vs eviction for non-payment.
In my rental contracts we put a clause in outlining non payment very clearly. If they fail to pay on the last day of the month. Eviction is filed on 2nd day of the next month. If they pay on the after the 2nd they owe rent plus filing cost ~$150. You never wait bc it takes so long to evict. When it's clear the person isn't paying and it's going to be a fight to evict. I'll do the $1k cash now to leave deal. Only ever had to do 2 evictions and both took the cash deal. Got the house back in a week after offering cash. It would have taken +3 months to evict.

Start eviction now. Depending on what state, it could take you 12 months to get them out..

Get the ball rolling on an eviction. Retain an experienced lawyer if you don’t have one already. Potentially offer “cash for keys” to get his ass out.
What does your lease say about termination? And what are your city & state laws? You may have to wait 30 days to evict. Start documenting and perhaps contact a local lawyer. This can be really tricky bc if you don’t do it exactly correct, he can sue for trebble damages

EY4 yes fired the second we found out which was because my wife told me to just go and speak to the tenant so I flew home because I was working overseas to speak to them. I ended up apologising profusely told them not to back pay as they had been withholding and left it in a side account and threatened to sue the management company if they didn’t pay me for loss of earnings and then fired them.

Start a mini fire just in part of the house. Make them move out so you can “repair the whole place”. Then claim business loss for the expense on the fire so it isn’t that bad financially. Can even get home insurance to cover it

Be rational not emotional. Find out why he is not paying first. If it’s an issue that needs fixing then fix it. If not start legal procedures ASAP.
