Not sure where else to post this. I’m trying to use my dependent care FSA for our nanny, who my wife has been paying. Just realized that her arrangement with the nanny is “under-the-table” which means the nanny does not pay taxes on the income. Can I still use my DC FSA funds?

What are documentation requirements to submit? Many years ago, I submitted a handwritten statement to pay grandparents. Did not withhold taxes.

like

Pretty sure no, can’t use it. Be careful, if your Nanny has to be let go (COVID anyone?), she can still claim unemployment and you and your wife will be effed as you’re the ones responsible for withholding.

like

It’s dicey at best. Most FSAs require you enter & document the service provider’s name and contact info in Order to verify/pay your claim. So if you’re ever audited, that info becomes material and it creates a paper trail that you weren’t properly withholding/paying for your nanny.

I want to stop "wasting" money on rent and build equity in a home, lay down roots, start a family, but I feel I/we will never be able to save enough for a down payment (NY prices, 400-500k).
