NY family lawyers- should a prenup address all points in the context of legal separation AND divorce? Or just divorce? Drafting a prenup and wondering what the standard is.

Both. Can never have too much info. If date of separation is relevant to a divorce which it is in most cases, include it. A prenup is essentially a conditional Divorce decree. Draft it precisely 😊

Novice investor here so please bear with me. I opened a vanguard account dec 2019 and invested around $1K..over the course of the year I invested about $68k.. I just checked the total gains and it shows about $10k. That’s about 14% gain via investment in small amounts in vgt, zoom, tsla, ark, vtsax etc..Is it fair to assume 15% gain year over year ?

I searched and i’m incredulous we haven’t had this discussion yet. What’s your position on LIV. I think it’s a league mostly of has beens and never was’s designed to stroke Greg Norman’s ego and personal vendetta. I have no problem if you want to take the money to play events no one will care about and won’t get world ranking points, but don’t think you can have it both ways.

I just hit my lean fire number but am hesitating to pull the trigger, so was hoping to run it by people smarter than me:

- I have a few rentals that bring in ~$1800/mo cash flow, taxes are negligible, Capex incl.
- My paper assets will bring in ~$1200/mo at 3% draw
- I get free Healthcare at the VA
- No plans on kids
- My expenses haven't topped $30k/yr ever
- I could always reenter the workforce if needed (albeit probably not in consulting)

Please point out the flaws here, what am I missing?

I went from making $70k the last 7 years to now started a new job a month ago making $130k plus $10k bonus every year, and $60k in RSUs. I have $70k in my 401k and around $50k in savings. Want to get out of the Silicon Valley which has been home my whole life and buy in TX or AZ a ~$400k house. I have about $20k in student loans which my dad has offered to pay (wants to make up for never supporting me) but I’m waiting to see what Biden decides for student loans. Is this feasible? Credit is ~615

Moved into a new house almost 2 years ago. Been receiving lots of mail from previous owners. For the first year and a half, we diligently kept up with keeping it and giving it to one of their friends who lives in our neighborhood to pass along. Also reminded them several time to forward mail. I’m done. For last couple of months I’m shredding mail and donating packages to goodwill. I’m not their P.O. Box and I gave them ample notice. What business development ideas have worked for you? I’ve thought about BNI but not sure how if it’s worth it.

Lawyers that love practicing family law, what do you like about it? Lots of lawyers say they will never practice family law (or will never again), but I know people that do love practicing it. I have (happily, for a while) been a public defender for 8 years and am thinking about leaving for another type of law. Family law seems like a possibility, but I don’t want to hate what I do.

Is it important to offer support staff that speak a foreign language or is it sufficient if the attorney can communicate with the client? We had one bilingual paralegal and another who is not. The bilingual one left us some time ago.

Thus, we are left with one who can’t communicate with about 25% of our clients. And there just isn’t enough revenue to support two paralegals despite my partner pushing us to hire.

Someone please tell me if I am crazy. I am at a family law firm with approximately 25 attorneys. I previously worked at small shops where I essentially handled everything myself with no support staff. Now at my current firm I have a paralegal who really only makes my job more difficult… am I crazy to say that I don’t need a paralegal as I am comfortable operating as a solo and pay me slightly. I’m already pretty much operating on my own anyway. Feel like it’s a win win.

Is anyone here familiar with RSUs and stock options as part of divorce? My arbitrator was not and she asked us to hire an expert to get a valuation. She’s convinced I cannot take my portion in kind if we could not settle on the value and I don’t want to be forced to sell my half to Husband at whatever valuation expert provides today (RSUs and stock options are under Husband’s name). If they low ball I rather take the risk and take them in kind. Any advice would be helpful.
