Speak with an attorney. I imagine you’d have bank records of previous years’ money transfers to the school and a document that proves what the tuition was for previous year, which should be strong proof.

The official rate is what he is using to say my dad owes 52k. My dad doesn’t pay the official rate he pays a discounted amount based on an unofficial offer the principal gave him for enrolling 4 children 3 years ago. There is no documentation for that agreement since it was verbal aside from bank statements

We’ve got lawyers in here now, what better place to come for your legal advice. So convenient!

Answer and I don’t even know the rest of the story: Speak with an attorney

But not before sharing all the juicy details

was a time share!

Were documents saying that $52,000 were still owed to the school due to incomplete tuition payments for the previous year. This amount is absolutely baseless and came up from nowhere. But the document is signed and my dad does not have a copy because the principal said he needs to get it notarized first. After my dad realized what he signed he said he didn’t agree to it but the principal said it was legally binding and had to be paid asap. My question is how likely do you think think this scheming will hold up in court?

like

UPDATE Turns out my Dad actually paid a preliminary amount during the meeting towards the 52k requested. Spoke to my attorney also and he asked that we request the document that was signed which we’ve done. No response yet but he thinks it’s a promissory note which my Dad can get out of since it’s civil

Why did your dad sign this?

He learned his lesson for next time

The real question is, why would they choose to send their child there next year now that this happened?

likefunny

It won’t get to court. It will be settled long before that point.

You should have fees structure and other documents that you signed prior to enrolling for this year that your dad actually agreed upon. Before all of that I would suggest calling them to discuss a payment plan and record the call. In that call by being polite make them admit to the scam. Once you have the recording ask them to cancel all the dues otherwise you would make the matter public and viral (we all can help make it viral) if they still don't budge go to cops for extortion and harrrasment using the call recording. If I were in your dad's position I would have started recording every call after the scam came into light. Good luck 👍

Agreements can be rendered void and unenforceable if entered into under fraud, undue influence, duress, mutual mistake, or misrepresentation

The specific facts and circumstances of your situation that may fit into that framework are best discussed with an attorney, but the general legal principle is called a meeting of the minds.

There has to be a bill or financial aid form? What kind of shady school is this? All private schools have tuition and financial aid forms online.

Hmmm. Sue me.
