Why are you jumping right to discrimination lawsuits, seems aggressive. Employers are mandated to provide a certain level by the government and anything beyond that is just good will on their part. This is something you should have looked into before signing a contract if it’s of high importance to you

If she is in the US there is no legally mandated maternity leave, thus no discrimination. This is something that might not be in a contract but would tend to be in published corporate policy. If it's not in the contract and no policy for it then there's no discrimination. If there is a policy for it and she doesn't get it or there is legally mandated maternity leave where you are and she is not given it then she has at minimum an HR complaint.

I'm not sure this information is always included in an employment contract, at least for the US. Policies change, so it's not something you'd want to put in a contract. Not sure what kind of company your wife works at, but she should likely look at company HR policies, wherever they are stored (company internet site, etc.)

If her company does not offer maternity leave the only option is listed below: The Family and Medical Leave Act of 1993 (FMLA) to go on maternity or family leave after the adoption or birth of a child. Under this law, legal parents are protected for up to 12 weeks of unpaid leave (per year).

Just recently went out on leave and this is correct however you do not qualify for FMLA if you have been at the place of employment for less than a year.

There is no federally mandated paid leave policy. We are pretty much the only western country without one. A few states have policies. Mostly, the best you can hope for is 12 weeks of job protection under FMLA, if she has been there long enough, and if her company is big enough. A contract normally would not mention these things. It would likely be in a benefits handbook that you can find internally or from HR
