Would it make sense to still try for it if I only meet the Operations side of requirements and not strategy side?

The lottery and a lot of our struggles has been driven by their abuse of the H1b visa purpose, so these changes are very welcome

For the rest of the folks who are reasonable: the way I see it, the overarching goal of this administration is to reduce legal immigration. Period. It doesn’t matter what fig leaf of logic they adopt to justify it. I’m hopeful it will weed out scamsters but can easily be used against anybody since the definition of speciality occupation is not a watertight one.

I am actually surprised how many people on here see this is as a good move and don’t see how this vaguely worded regulation can also be used to target those who came to the US through legitimate channels, invested in education and are a valuable resource to the firm.
Yes I understand that it will further eliminate the misuse of the H1B program by IT body shops but what make you think this generalized and vague definition of specialty occultation will spare lot of good folks who didn’t abuse the system?
This might involuntarily affect me also, but that doesn’t mean I should not call out the fact that there are a lot of people who do not care/value the ‘I’ of Integrity, exploit the High Specialty Occupation Visa. People like them have brought all of us to the place where we are now !
The biggest impact this will have for us is the general perception that hiring H1-Bs for consulting roles is about to become more “cumbersome”. Consulting firms will start to prefer locals to ward off the uncertainty of visa denials and cost of annual continuous extension applications.

In a way it’s all good, I know several H1B technical managers who know nothing about any technology other than beating around the bush during meetings. H1B - High Specialty Occupation definition is a joke.

The updated regulations redefine "specialty occupations," limit the validity of an H-1B visa to one year for a worker placed at a third-party worksite, and increase enforcement tools to police companies that do not abide by H-1B rules or cooperate with site visits.
That will screw all consultants - strategy, management, tech...everyone
Depending on which side of the boat you are on, the perspective can be very different.
If I were American, most likely I’d be happy about any of such IFRs.
If I were a tech company CEO, I’d be concerned only because it affects hiring and costs.
As H1-b holders, or to-bes, you are screwed over any way.
This is an H1B group so you know might be very clear which side of the boat all of us are.

This is bound to be challenged in court since a court decided that Chad Wolf was likely illegally assigned as the secretary or acting secretary of DHS. Furthermore this rule is an interim final rule which is bound to face questions.

I know, many H1B holders stick to doing documentation on word file and seek for Scrum master roles which I think is unfair to qualified technical people who also get affected by such DHS rules.
Seems fairly reasonable to me tbh. This will be good for immigrants too bc hopefully it'll increase their chances of being selected for h1b and then reduce the GC wait times. What part specifically do you not like?
If there is real need they will pay us whats needed. If there isn't a real need then I guess it makes sense

They are recommending a 45th percentile as level 1 wage. 45th percentile of what data set has not been verified yet... As in, within an MSA or. a job code or just all h1bs. That'll essentially wipe out all level 1s and maybe even half or full of level 2s. That's a steep change
Any of you still think this will not impact you or is “good for you”? You might want to check your paycheck before answering.

People who say this is a good thing - this rule effectively raises L2 wage to current L4 level. To give you an idea, L4 wage for my current occupation filed in NYC is 170k. Go figure if you hit that

I think they did this just for the election knowing very well that it will be stopped at the courts. It is just bad for people who are caught in between with active petitions. This will go to courts very soon.
Even if the wage rule doesn’t affect people, the 3rd party location rule will affect many consultants. If somehow this stays then companies will rethink H1 hiring as a whole.
This also affects immigration lawyers so they are not gonna just let it go easily.
