Question for second/third year associates at a litigation firm (for reference, I work at a boutique size firm): to what extent is your boss or the partner involved in a case, specifically discovery, on a daily basis? My boss is available if I have questions, but I feel like I’m on my own most of the time... Just trying to get a sense of what’s “normal.”

You want exactly this from both a development and marketability perspective. You can’t grow if a partner controls every aspect of the litigation. And firms LOVE an associate that is capable of running his or her case from complaint to judgement. If your firm gives you that level of autonomy, you should appreciate it and use it to your advantage.

I could have written this post myself word for word. I’ve just started taking on a lot more recently and sometimes I feel like I’m drowning with no life preserver. I feel like I’m seen as stupid/incompetent for asking basic questions but I’m also terrified to mess things up by doing the wrong thing, and I feel like the partners forget how new and clueless I am and expect me to just know the right course of action in discovery.

I’m the same! I have a lot of control over my cases on a daily basis but I’ll fill my boss in on what my plan is and she’s always available for questions.

Bought a car today. Finance Manager tried to get me to sign the Bill of Sale without reviewing the carfax report, despite it being mandated by the Motor Vehicle Dealers Act. She ultimately gave it to me after I insisted and contrary to her initial assurance, when I looked at it myself, the car had an open recall. California attorneys — I am having difficulty finding authority concerning the use of a rejected (partial) settlement offer to claim that a party failed to mitigate their damages. I.E. plaintiff could have mitigated if they accepted the (partial) settlement offer. Defendant offered to settle one claim (without affecting the others). Plaintiff rejected. The value of damages has increased over time and now defendant claims that plaintiff failed to mitigate because they did not accept the offer. TY
