Random question - how is child support decided? What if there is no alimony because the parents were never married and let’s say it is a one night stand. How does a court decide how much child support needs to be paid? Is it negotiable? Not asking for legal advice. Just curious about how the system works.

State guidelines dictate percentage. In Texas a custodial parent is entitled to .20 of net income of non custodial parent. The cap is at 1600 per month but these are guidelines and judges don’t have to adhere to them. Refer to your states family law.

Mc1 is correct there are state guidelines that set a base but other things like income also come into play

Worked with a lady for many years who fit this exact scenario. She had a one night stand and raised the child. The father provided some support - I don’t think there was a court order. It really messed up the lady’s life (had to drop out of college - lots of shame) - she never married. She’ll retire from the same job she’s had for over 30yrs next year, her daughter turned into a great woman and has a family and children of her own now.

Try to see if you can arrange a meeting with a judge. Thats what I did back in the day and we set up an agreed amount that doesnt go through the state. Its worked for 12 years.

It's calculated based on income (yours, theirs, and total) and parenting time. Very few states, if any, have any discretion in deviating from the prescribed calculations. You can Google "child support worksheet [state]" and find out how to calculate.

MC 1 is correct. From the state's point of view, that is the child's money and the parents can't agree to a lesser amount.

Anyone know a good lawyer in NYC who wont rip me off?

funny

Now that’s a challenge.

If you want to negotiate, it would be an agreement between the 2 parents in lieu of letting courts decide based on the criteria set for their state.

Child support is determined based on a multitude of factors, such as financial stability of both parents, educational background, earning potential, etc. It’s more of a sliding scale than a cookie cutter sticker price situation.

Hi all, 3 years into MBB and job was taking the toll on me, and we were unable to get pregnant. I forced myself into an internal role to get some breathing space and therapy, and we ended up getting pregnant. But a few months in, I moved back to client facing and it has been absolutely difficult to spend time at home and keep my wife happy. She is expecting some quality time every day for a few hours, and I am just unable to do that. Its probably a combination of the job and also how I

How do you all deal with family members who ask you for legal advice? Specifics: My father in law is trying to negotiate a buyout of his interest in a company in California he owns 1/3 of and he keeps asking my husband (a patent attorney in IL) and me (a divorce attorney in IL) to help them draft or negotiate contracts. They don’t want to talk to another lawyer. We have told them ad nauseam we aren’t qualified. They keep hounding us for “advice” we don’t have. The company hired a lawyer today.

What is the federal parental leave policy? I’m new to government and having a baby soon. I know we’re given 12 weeks and have to sign an agreement to work 12 weeks after we return but are there other stipulations to a claw back period or how long we had to be at the agency first?
